Police Arrest 2 Men at Timonium Gun and Knife Show

The pair allegedly responsible for selling illegal, high-capacity magazines.

 

UPDATE (4:12 p.m.)—Two men were arrested over the weekend after allegedly selling illegal high-capacity magazines at the Timonium Gun and Knife Show, according to Baltimore County police.

John Heilmeier, 57, of Cumberland, VA, and Richard Summers, 64, of Waldorf, MD, both face firearms charges after an undercover officer observed the sale of what police said was a 30-round magazine.

The detective witnessed the sale on Jan. 11 during the gun show at the Maryland State Fairgrounds,  according to a statement released Wednesday by the Baltimore County Police Department. Both men were taken into custody at the show and were later charged with misdemeanor offenses related to gun-related transactions.

UPDATE (6:05 p.m.)—Gun show spokesman Neil Kravitz said the police version of events were "not exactly true." 

Kravitz explained, "the guy sold a magazine that was pinned," to only hold 20 rounds by manufacturing settings, although the magazine could be manipulated to hold 30. Kravitz said Heilmeier got himself into trouble by demonstrating to an undercover officer how to disable the mechanism, that would allow for added ammunition. 

"This is a very old trick," Kravitz said. "People use this to increase or decrease the number of ammo a magazine can hold." 

Kravitz described the three components that comprise a magazine: the shell, the spring and the follower (or "stop"), which prevents bullets from falling down into the bottom of a magazine.

"To make it meet state law, they [the manufacturer] put in the stop," Kravitz said. "John [Heilmeier] has been doing gun shows a very long time. ... He knows better than to sell a high-capacity magazine in Maryland." 

Kravitz said Heilmeier's tenure at the gun show stretches back at least 10 years. Heilmeier labeled his wares as 20-round magazines. And at the time of sale, that was accurate, according to Kravitz.

In Maryland, it is illegal to sell, trade or barter for a magazine that can hold more than 20 bullets, although it is not illegal to own one, according to Kravitz. 

"It's one of the loopholes in the law," he said. 

The item in question, as well as 121 additional allegedly illegal magazines, were seized by police, according to the police news release. 

"He started out with a magazine that meets the law to the letter," Kravitz added. 

However, when the undercover detective asked if the mechanism "stopping" the bullets could be disabled, Heilmeier reportedly demonstrated to the officer how, Kravitz said. 

"John should have known better and he knows that," Kravitz said. 

There hasn't been an incident "like this," committed under the watchful eye of the gun show's organizers (Appalachian Promotions) since its inception in 1989, according to Kravitz. He conceded that there have been instances of people selling guns out of the trunks of their cars in the Timonium Fairgrounds parking lots.

Police announced the arrests Wednesday afternoon, three days after the Gun and Knife Show concluded. 

“It is critical to have effective laws regarding high capacity magazines,” Police Chief James Johnson said. “And it is equally important for those involved in the sale of firearms and related equipment to conduct their business in a responsible and law-abiding fashion. These laws are in place to protect public safety, and violations such as this endanger the community.”

Johnson and County Executive Kevin Kamenetz announced in December that the county was making tougher gun laws a priority in 2013.

"This shows our commitment to public safety regarding existing firearms laws in Maryland," polices spokeswoman Cpl. Cathy Batton said. 

Trials for Heilmeier and Summers are scheduled for May 14. Both men face up to three years in jail and/or a fine up to $5,000, Batton said. 

Police said charges are pending for the customer who they said purchased the illegal magazine. Police are withholding the name of the customer until a full investigation can be completed.

The Investigation, according to police (4:45 p.m.)—

An undercover detective witnessed two customers at the Timonium Gun and Knife Show ask for a magazine that would fit a .223 caliber AR-15 rifle.

It was a common question on the day, with many customers stock piling ammunition and assault rifles (and accessories) following talk of an assault rifle ban at state and federal levels.

The vendor allegedly sold the customers what appeared to be an illegal 30-round magazine, police observed.

Police interviewed the customers and determined that the item purchased was illegal to own in Maryland.

Undercover detectives went back to the same vendors and asked to purchase specifically a 30-round magazine.

"The vendor told the detective that he could not say '30-round magazine' because he was in Maryland, but assured the detective that he could buy the magazine that he was looking for," according to a police news release.

Baltimore County police spokeswoman Cpl. Cathy Batton said it was John Heilmeier who spoke directly to the undercover detective.

The detectives purchased two magazines, which were labeled as holding 20 rounds although further examination showed that each magazine could actually hold 30 rounds.

Police arrested the vendors and seized 121 additional illegal magazines from the stand.

Ironic you use the term scary rifles. The semi automatic 22 hunting rifle uses the same mechanism as the AK47 and most all other semi-auto's. The shape of the gun is what makes some guns scary to some. To others it's the caliper and velocity or the type ammo such as hollow point. For most people who are complaining about guns, they probably have never used or needed a gun, thus their ignorance of those who do. Try killing a rattle snake with a stick. Try killing 2 or three with 2 or 3 sticks or a single shot before you get bit. Try fending off a wild hog with a .22 single shot. Or better yet try fending off 2 intruders entering your home with a single shot. You pukes make me sick with your liberal bs. You know nothing about self defense. And the founding fathers wrote the 2nd amendment to guard against tyrannical government more than intruders.

Al Day - maybe I'm not totally up to date, but you say that a .22 is similar to an AK47 round? I didn't know the AK47 used a rim-fire cartridge. And I'm not sure what a two-legged measuring device (caliper) has to do with the difference between a hunting rifle and an assault weapon. Calibre, yes. It might help if your spelling skills advanced to the level you think you have reached. Otherwise some might think you are responding during your breaks while doing your homework.

For the extremely naive.... if 7 shots is all it takes in a fire fight. most police depts (including Baltimore County) in the 80's wouldn't have issued 15 shot magazines with their Sig Sauer P226 9mm automatics and 45 rounds total .. 30 in back-up magazines (or similiar baretta;s or glocks), and Joseph Palzinski would have been shot one time between the eyes, instead of 33 rounds a second from a Tac 9 machine gun.

Or just confused by the rhetoric. Obama has been spewing comments about banning high capacity clips. I do see they were aware of this particular infraction, though, in fairness to law enforcement. The law itself is the issue. It is wrong. We have a duty to resist tyranny in any form. I didn't just make that up either. It was written by one of the founding fathers during a time when the redcoats were trying to round up guns at the beginning of the revolution.

I couldn't agree with you more "Stop Crime"... Just know you have others out there that do share your opinions and ideas :) As a multiple gun owner myself, and yes responsible as well, use my guns for hunting as well as target shooting. We should not be deprived of that by having ridiculous restrictions put on us law abiding citizens. The problem is clearly the economy and mental health. Anyone that cant see that....well its useless even trying to go there. I just hope someday they are not on the opposite end of a gun praying for their life with no protection to defend their self or their family. I'll be damn if i ever am!!

Well said. Stupid liberals think that making certain weapons illegal and certain magazines illegal that it will stop violence.

The thing is, these laws aren't retroactive - meaning those who own them don't have to turn them in. Criminals will still steal stuff, and retroactive laws won't work. That's been proven in Nazi Germany and other countries in Europe during WW2. Look how that turned out!

Exactly.. It never has made sense to me how these libs think banning and restricting certain types of guns, ammo, or magazines will stop crime and killings. Really now, when is the last time you heard criminals register or follow proper procedures in obtaining these items...WELL U DON'T!!!! THEY DON'T!!!!!! A lot of people posting are right, some by fact, some opinion, but honestly, until our country and the individuals living in it recognize, acknowledge and deal with mental illness, these mass killings will go on. Disturbed people will find a way...where there is a will...? The people these laws will affect are street criminals- which is awesome, we need to stop that as well- but we should have YEARS ago! Politicians are being demanded into a call for action by constituents, but really the causes and affect (and effect) do not align. But, how in the world do they address the root of the problem, I don't think anyone knows! That's why bullies too continue, no one really knows how to stop it before it starts, and demand the school fix it, when, unfortunately, it is too late- much like the gun/ health issue. I do not think the problem is political so much as it is reallya loss for a solution- a preventative one- on all levels and sides. Very sad.

The second amendment right or wrong is not a God given right. I am not sure there is such a thing. As far as guns it is clear that hunting firearms have limited capacity magazines and in many instances require plugging or further obstructing the magazine to keep it sporting. Obviously for killing things in greater numbers a large capacity magazine is an enhancement to that goal or they would not exist.
I don’t so much support banning Assault weapons or magazines as much as I fully support limiting the number of weapons, number of magazines and the number of rounds, type of rounds and the manner in which you store and transport your weapon. These guns are weapons of war made for killing people and sometimes that is necessary. That said even the military and the Police conform to protocols and a convention.

The clamor for gun bans or regulation is so short-sighted that it is sad. When the Soviets aimed nukes at us, we avoided destruction by aiming some back and let them know we did. It was called mutual assured destruction (MAD). And it was very successful (we are still here to talk about it). Same principal with guns (or knives, malatov cocktails, bricks, rocks, bows and arrows etc. It's impossible to round up all the weapons that can be used to do evil. To attempt to do so in order to solve the problem is akin to trying to drain the ocean to catch the fish. Fool-hearty at best. And to all you dreamers who think gun control/legislation is the answer you need to wake up. If guns are outlawed, only outlaws will have guns. Why not disban the Army to make the world peaceful? Because it is pure fantasy and not related to reality. Politicians always go for the stupid simple approach with lights blinking around the edges to suck in those who are easily led.

We should all be able to own guns and other weapons without government interference. The only people we are hurting with increased regulation of firearms are law abiding citizens. The evil and insane will still be able to illegally acquire weapons to mass murder. If the guy in CT was unable to steal his mother's guns then he would have devised some other way (i.e. explosives, car bomb, etc.), which probably would have killed even more people. Thank you Al Day for standing up for our second amendment right, which the government cannot infringe upon.
Why is Chicago not the safest place in our country (strictest gun laws)?
Why is it ok for the US government to give assault rifles to Mexican drug cartels but go after those of Americans?

Lets just look at pure numbers. You anti's have any idea as to how many of these "evil rifles" are out and about? And what we have a handful of cases every year involving them? A lot of shootings recently havent even had them.

Here's a hint...there will be more people killed in Baltimore this year at the hands of knives, handguns, and blunt objects then all the school shootings combined in a decade....let alone the ones soley done by these "evil rifles".

If every "evil" rifle was being used to kill innocent folks...sure...but the numbers do not support that.

Look at the vast majority of violent crimes...handguns and knives....VERY VERY few are done by these evil looking rifles.

I know reality hurts liberals....I mean after all they are scary looking and you folks dont understand them. So why not be scared of those evil looking man killing objects instead of approaching the core issues of the sad sad mental health system in the US.

I agree Darrell, there is much more to fear out there every day on the "real streets" with "real criminals" then to bust two 60 yr old men selling a magazine. Not much of a threat there I guess.

Well don't you think they should spend some time trying to keep the drug dealers from getting expanded magazines in the first place? Or do we wait to confiscate them at a crime scene?

The drug dealer's control perceived law enforcement....they actually own a portion, and our government provides weapons to the drug cartels...this arrest at the gun show was nothing more than a silly show of odd police behavior at it's best...no citizen is any safer as a result and taxpayers will foot the prosecution tab...pretty lame..

Multiple sheriffs in some sothern states say they won't be enforcing Obama's silly "feel good" laws. Good for them. They won't let them enforce federal immigration laws, so why should they be enforcing this crappolla ?

What can be said about people who want to desecrate the second amendment for the citizens of USA.. JUST AS LONG AS THEY CAN DO WHAT THEY WANT TO DO
